RETURNS AND REFUNDS
Due to the original and individually handmade nature of Naomi Katz artworks, returns, refunds or exchanges are not offered for change of mind, incorrect choice, subjective dissatisfaction, or where an artwork is no longer suitable for the purchaser’s space.
HANDMADE AND MATERIAL CHARACTERISTICS
Each artwork is individually handmade using materials and processes including hand-poured resin, pigment, mirrored acrylic, paint, foil and hand-applied finishes. These artworks are handmade objects and are not represented or sold as having a factory-produced, mechanically uniform or machine-perfect finish.
The nature of these materials and processes means that subtle organic variations are inherent characteristics of each artwork and are not considered faults or damage.
These characteristics may include:
• Minute air bubbles
• Tiny dust specks or particles within or on the resin finish
• Small spots, marks or inclusions
• Subtle ripples or undulations in the resin surface
• Slight variations in resin flow, clarity, level or texture
• Minor variations in hand-applied paint, foil, leaf, edges and finishes
• Fine internal marks, linear scratches or abrasions beneath the final resin surface or within or between the mirrored acrylic backing, painted surface and foil layers, including characteristics arising during the manufacture of the mirrored material
• Optical variations, reflections or refractions created by the interaction of resin, pigment, foil and mirrored surfaces
Minor handmade or manufacturing characteristics that are not readily visible from a normal viewing distance of approximately two metres under normal indoor lighting—and become apparent only on close inspection, under concentrated, direct or raking light, through photography, or from particular reflective angles—are considered part of the handmade character and finish of the artwork rather than defects.
An artwork will not be considered faulty merely because a purchaser expected a perfectly uniform, flawless or machine-manufactured finish, or personally considers an inherent handmade or material characteristic undesirable.
Whether an issue constitutes a fault will be assessed objectively by reference to the artwork’s description, materials, handmade method of production, overall appearance under normal viewing conditions, structural integrity and intended function. Subjective dissatisfaction with an inherent handmade or manufacturing characteristic does not provide grounds for a return, refund, exchange or price reduction.
This does not apply to significant damage or a genuine defect that materially affects the overall appearance, structure or intended function of the artwork. Nothing in this section limits any rights that cannot lawfully be excluded under applicable consumer law.
PHOTOGRAPHS, COLOUR AND REFLECTION
Every reasonable effort is made to represent each artwork accurately. However, colours, reflections, luminosity and surface effects may appear differently depending on lighting, surroundings, viewing angle, photography and individual screen settings.
Reasonable differences between the appearance of an artwork in photographs or video and its appearance under the purchaser’s own lighting conditions are not considered faults and do not provide grounds for a return or refund.
COMMISSIONED ARTWORKS
Commission deposits are non-refundable for change of mind once the commission has been confirmed and work has commenced.
Once a commissioned artwork has been approved and created to the agreed specifications, returns, refunds or exchanges are not accepted for change of mind, subjective dissatisfaction with inherent handmade characteristics, or minor variations resulting from the artistic and handmade process.
