TERMS AND CONDITIONS

By purchasing an artwork or commissioning an artwork from Naomi Katz Art, you agree to the following terms.

PAYMENT

Full payment is required for available artworks before dispatch.

Commissioned artworks require a 50% deposit to confirm the commission and reserve the agreed production allocation. The remaining balance must be paid before the completed artwork is dispatched.

COMMISSIONS

Commissioned artworks are individually designed and handmade. The estimated production lead time is approximately 4–10 weeks, unless otherwise agreed in writing. This is an estimate rather than a guaranteed completion date.

A design will be prepared for approval before production. Up to two reasonable design revisions are permitted during the approval stage. Once the design has been approved, the artwork will be produced according to the approved design while maintaining the artist’s creative discretion and the handmade nature of the work.

Colours, resin formations, reflections, refractions, pigment movement and other organic elements cannot be replicated exactly from another artwork or digital design.

COLOUR, MIRROR AND DIGITAL IMAGES

Every reasonable effort is made to represent artworks accurately online. However, colours may vary between screens and devices.

Mirrored acrylic, resin, metallic surfaces and gold leaf are highly reflective and can appear significantly different depending on lighting, viewing angle, surrounding colours and the environment in which the artwork is displayed. Photographs, videos, digital mock-ups and renders are therefore representations rather than guarantees of an identical appearance in every environment.

INSTALLATION AND CARE

Unless specifically agreed in writing, installation is not included in the purchase price.

The purchaser is responsible for ensuring that the artwork is installed securely using fixings and methods appropriate for its size, weight and the wall or structure on which it is installed. Professional installation is recommended, particularly for larger artworks.

Naomi Katz Art is not responsible for damage resulting from improper installation, handling, storage, cleaning, exposure to unsuitable conditions or alteration of the artwork after delivery, except where liability cannot legally be excluded.

OWNERSHIP AND COPYRIGHT

Ownership of the physical artwork transfers to the purchaser once payment has been received in full.

Copyright, design rights and other intellectual property rights in the artwork remain with Naomi Katz, unless expressly transferred in writing.

Purchasing an artwork does not grant the purchaser the right to reproduce, manufacture, copy, commercially exploit, licence or create commercial derivative works from the artwork or its design.

Naomi Katz retains the right to photograph and reproduce images of artworks for portfolios, exhibitions, publications, social media, marketing and archival purposes.

DELAYS OUTSIDE OUR CONTROL

Naomi Katz Art is not responsible for reasonable delays caused by circumstances outside its control, including shipping disruption, customs processing, severe weather, supply delays or other unforeseen events. Where a material delay occurs, reasonable efforts will be made to keep the purchaser informed.

CONSUMER RIGHTS

Nothing in these Terms and Conditions excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

These Terms and Conditions are governed by the laws of Victoria, Australia, subject to any mandatory consumer protections that may apply.
